Yes. A signed formal contract is not strictly mandatory. For a judge to admit the claim, we can present emails, accepted quotes, delivery notes, WhatsApp messages, or previous billing history.

Spanish law establishes a general 5-year statute of limitations to claim unpaid invoices or commercial debts. However, we recommend acting within the first 6 months, before the debtor company enters bankruptcy or shuts down.

Our first step is always out-of-court resolution. We send a formal legal demand (burofax) drafted by attorneys. In a high percentage of cases, the pressure of receiving a formal notice from a law firm is enough for the debtor to pay without trial.

If the case proceeds to trial (such as ordinary proceedings) and the judgment orders the debtor to pay 100% of the claimed amount, judges usually award legal costs against the debtor. This means the debtor will ultimately pay your attorney and court agent fees.
